AGENTS MASKS IP LICENSE & TERMS OF USE
By purchasing, receiving, holding, or transferring an Agent mask, you agree to these terms.
1. NFT Ownership
Ownership of a Chosen Agents Mask is determined solely by the Ethereum blockchain and the wallet address that controls the NFT.
When you purchase a Chosen Agents NFT, you own the NFT token itself, subject to these Terms.
2. Intellectual Property License
As long as you own an Agent Mask, you are granted an exclusive, worldwide, transferable, royalty-free commercial license to the artwork associated with that specific NFT.
This license allows you to:
• Display the artwork publicly and privately.
• Use the artwork for personal purposes.
• Use the artwork for commercial purposes.
• Create and sell merchandise featuring the artwork.
• Create derivative works based on the artwork.
• Incorporate the artwork into brands, businesses, products, games, books, films, media, and other creative projects.
• License your NFT artwork to third parties.
3. Exclusivity
The rights granted under this license are exclusive to the current owner of the NFT associated with the artwork.
No other NFT holder receives rights to your specific NFT artwork.
4. Transfer of Rights
When you transfer ownership of the Agent Mask NFT to a new wallet address (via a secondary sale or any other transfer on the Ethereum blockchain), the exclusive commercial license granted under Section 2 automatically transfers to the new owner.
The previous owner’s license terminates immediately upon transfer. No rights to the artwork remain with the former owner.
You may not retain any license, sublicense, or usage rights to the artwork after you no longer own the NFT.
5. Termination of License
Your license to the artwork ends automatically and immediately if:
You sell, transfer, or otherwise relinquish ownership of the Agent Mask NFT.
You breach any material term of these Terms of Use.
The project or creators terminate the license for cause (e.g., illegal use of the artwork).
Upon termination, you must immediately cease all use of the artwork and destroy or delete any copies in your possession (except for the NFT token itself, which you no longer own).
6. Restrictions
You agree not to:
Claim ownership of the underlying copyright in the original artwork.
Use the artwork in a way that depicts or promotes hate, violence, illegal activities, or pornographic content (unless the specific mask artwork already contains mature themes).
Register trademarks or seek copyright protection in the artwork itself (you may trademark derivative brands or products you create).
Use the artwork in a manner that suggests endorsement by the Agents Masks project or its creators without prior written consent.
Reverse engineer, extract, or create new NFTs from the artwork outside of the rights granted here.
7. No Warranties
The artwork is provided “as is.” The Agents Masks project and its creators make no warranties regarding the artwork, including but not limited to merchantability, fitness for a particular purpose, or non-infringement of third-party rights.
You use the artwork at your own risk.
8. Limitation of Liability
To the maximum extent permitted by law, the Agents Masks project, its creators, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to these Terms, even if advised of the possibility of such damages.
In no event shall total liability exceed the amount you paid for the specific Agent Mask NFT.
9. Governing Law
These Terms are governed by the laws of the jurisdiction where the project creators are primarily based (or, absent specification, the laws of Singapore), without regard to conflict of laws principles.
Any disputes shall be resolved exclusively in the courts of that jurisdiction.
10. Changes to These Terms
The project may update these Terms from time to time. Continued ownership or use of an Agent Mask after changes are posted constitutes acceptance of the updated Terms.
